1. Agreeing to these terms

Festival Coyote ("the Service") is the website at festivalcoyote.com. It is owned and operated by Heirloom Lands LLC, a Colorado company ("we", "us"). By using the Service, or by creating an account, you agree to these terms. If you do not agree, please do not use the Service.

You must be at least 18 years old to create an account.

2. What Festival Coyote is

Festival Coyote is a discovery tool. It lists festivals and gatherings that are taking applications from performers, artists, teachers, vendors, crew and volunteers, and it gives you tools to plan a season: a map, a circuit planner, an application tracker, a press kit, and a board where vendors post positions.

We do not run the events we list and we do not decide who is accepted. When you apply, you apply on the organizer's own form or by their own process, under their terms. Any agreement about a booking, a booth, a ticket, pay or a work exchange is between you and the organizer or vendor. We are not a party to it.

You need a free account to use Festival Coyote, including the map, the circuit planner, the application tracker, the press kit editor, Vendor View and your settings. The discovery page, the public open-call pages, shared press kits, pricing, the Privacy Policy and these terms can be read without one.

The Service is in beta. Features may change, break or be removed.

4. What we ask of you

5. Listings and their accuracy

Listings come from organizers' public websites and application pages, from events submitted to us, and from organizers who have claimed their listing. We check them by hand and with automated tools, and a "checked" date shows when a listing was last reviewed.

Even so, a listing can be wrong, incomplete or out of date. An application can close early, a deadline can move, a link can break, and an event can change its dates or be cancelled. Always confirm the details with the organizer before you rely on them, especially before you spend money or travel.

Event names, logos and poster images shown on a listing belong to their owners and are shown to identify the event. If you run an event listed here, you can claim your listing to correct it, replace its image, or ask us to remove it.

A "Featured" label means the organizer paid for placement. It does not mean we endorse the event, and it has no effect on who the organizer accepts.

A card marked "Sponsored" is a paid placement from a business. It is not an event listing, it does not mean we endorse the business, and it has no effect on which events are shown or on anyone's applications. Links in it go to the sponsor's own site, which has its own terms.

Notes about working in another country (visas, permits and similar) are general pointers, not legal advice. Check the official source for the country you are travelling to.

6. Applying, Vendor View and work exchange

Positions on Vendor View are posted by other users. We do not vet them. An "unverified" label means exactly that. Before you agree to a trade or a work exchange, get the terms in writing, check the event is real, and tell someone where you are going.

You should never have to pay to be considered for a position. If a listing asks you to, or anything else about it seems wrong, use "Report this listing".

When you apply to a position on the Service, the vendor receives what you send: your name, your email address, your message, and your press kit if you choose to attach it.

If you post a position, you are responsible for describing the exchange honestly and for how you treat the people who apply.

Some festival roles take applications on the Service itself, where the festival's organizer has chosen to. When you apply that way, the festival's verified organizers receive your name, your account email, your message and, if you attach it, a copy of your press kit. The decision is the organizer's alone. We do not review applications, take part in the decision, or guarantee an answer, and any agreement that follows is between you and the organizer.

A gig shown as "confirmed by the organizer" means that a verified organizer of that festival confirmed it. We do not check it ourselves. If you manage a listing, confirm only what your own records support, and use what applicants send you only to consider and contact them about your event.

7. Your content

You keep all rights to what you put on the Service: your press kit, photos, videos and files, your vendor listings, the events you submit, and your messages.

You give us a non-exclusive, worldwide, royalty-free licence to store, display, reproduce and share that content, only as needed to run the Service. For example: showing your press kit to someone you send the link to, showing your vendor position to people browsing, or showing an event you submitted on the map. The licence ends when you delete the content or ask us to delete it, apart from copies in routine backups and anything we must keep by law.

Some of what you add is public by its nature. A press kit link can be opened by anyone who has it. Uploaded photos, videos and files can be opened by anyone who has their address. Vendor positions are visible to every visitor. Do not upload anything you need to keep private.

If you send us feedback or suggestions, including through the beta test, we may use them freely and without payment.

What we collect and how we handle it is set out in our Privacy Policy.

8. Our content

The Festival Coyote name, the site's design, its code, its written copy and the collection of listings as we have compiled, checked and arranged it belong to Heirloom Lands LLC and are protected by copyright and other laws.

You may use the Service for your own planning and applications, and you may share links to it. You may not copy, mirror, resell or republish the Service or its listings in bulk, build a competing database from it, or use it to train an AI model, without our written permission.

9. Copyright complaints

We respect other people's work. If you believe something on the Service infringes your copyright, email info@festivalcoyote.com with the subject "Copyright notice" and include:

We will respond to valid notices under the Digital Millennium Copyright Act (17 U.S.C. § 512). If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address. We may close the accounts of people who infringe repeatedly.

10. Plans, payments, cancelling and refunds

Finding events and applying to them is free. Creatives never pay to be considered, and no paid plan gives a creative more visibility to organizers or better odds of being accepted.

Some tools are part of a paid plan. During the beta they may be offered free, and some testers may be made founding members. Founding membership and any other free access is granted by us individually and can be withdrawn if these terms are broken.

Where a price applies, the price and what it covers are shown before you pay. Payments are handled by a third-party payment service under its own terms. Some plans are switched on by hand after a payment arrives, which can take up to a day or so.

Cancelling. You can cancel a paid plan at any time by emailing info@festivalcoyote.com from your account's email address. Your plan stays active until the end of the period you have already paid for, and you are not charged again. Your account, and everything in the free part of the Service, stays open.

Refunds.

Refunds go back to the way you paid. Nothing here limits any refund right the law gives you.

11. Other services we rely on

The Service links to organizers' websites and application forms, and it relies on other companies for hosting, accounts and file storage, email delivery, map data, place lookups, fonts, and embedded video from YouTube and Vimeo. Your use of those is subject to their own terms. We are not responsible for their content, accuracy or availability.

12. Removing content and accounts

We may review, edit, hide or remove any listing or other content, and we may limit, suspend or close an account, if we believe these terms have been broken, if something is misleading or unsafe, or if it is needed to protect the Service or the people who use it. Where we reasonably can, we will tell you why.

If your account is closed, your right to use the Service ends and your content may be deleted.

13. No warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that:

14. Limit of liability

To the fullest extent the law allows, Heirloom Lands LLC and its owners, staff and contractors are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service. That includes a missed deadline or opportunity, a rejected application, travel or other costs, lost income, lost data, and any dealings or dispute between you and an organizer, a vendor or another user.

Nothing in these terms limits liability that cannot be limited by law.

15. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change is significant, we will say so on the site or by email to account holders. Using the Service after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules. Any dispute about these terms or the Service will be brought in the state or federal courts located in Colorado, and you and we agree to those courts. If you are a consumer living somewhere whose law gives you rights that cannot be waived, those rights still apply.
